1. Parties

This Distance Sales Agreement (the “Agreement”) is concluded electronically between the Seller and the Buyer identified below.

BUYER

The Buyer's full name or company name, delivery address, telephone number, and email address shall be those provided by the Buyer during the checkout process.

2. Subject of the Agreement

The purpose of this Agreement is to establish the rights and obligations of the Seller and the Buyer regarding the sale and delivery of the product(s) ordered electronically by the Buyer through the Seller's website, as described in the order summary, including their specifications and sales prices.

This Agreement is governed by Turkish Consumer Protection Law No. 6502, the Turkish Regulation on Distance Contracts, and other applicable legislation.

3. Product and Order Information

The type, category, model, color, quantity, sales price, payment method, delivery address, billing information, and any applicable shipping charges shall be as specified in the order summary presented to the Buyer at the time of purchase.

Such information constitutes an integral part of this Agreement.

4. Product Categories and Delivery Times

Products offered by the Seller may be classified as follows:

4.1. In-Stock Products

In-stock products are items readily available at the Seller's warehouse or operational facility.

Unless otherwise specified, these products will be dispatched within 1–4 business days following order confirmation and payment approval.

4.2. Pre-Order / Specially Sourced Products

Pre-order or specially sourced products are items procured specifically after an order has been placed.

The estimated delivery time for such products will be indicated separately on the relevant product page or in the order summary.

Delivery times may vary due to supply chain conditions, logistics, import procedures, customs clearance, public holidays, peak periods, or similar circumstances.

The Buyer acknowledges that pre-order products may require longer delivery times than in-stock products and confirms having been informed of the estimated delivery period before placing the order.

Any changes to delivery schedules shall be subject to the Buyer's statutory consumer rights.

5. Delivery and Fulfillment

Products shall be delivered to the address and recipient specified by the Buyer during checkout.

The Seller is responsible for delivering the ordered products within the agreed delivery period, subject to applicable legal exceptions and maximum statutory delivery periods.

In the event that delivery becomes impossible or extraordinary circumstances arise, the Buyer shall be informed through an appropriate communication channel.

If an order contains both in-stock and pre-order products, the Seller may arrange delivery in a single shipment or multiple shipments, depending on operational requirements.

6. Payment

The Buyer agrees to pay the total order amount using the payment method selected during checkout.

An order is considered confirmed upon successful payment authorization.

If payment cannot be completed due to issues involving a bank, payment service provider, or card processing system, the Seller's obligation to deliver the products shall not commence.

7. Right of Withdrawal

Subject to applicable statutory exceptions, the Buyer has the right to withdraw from this Agreement within 14 days without providing any reason and without incurring a penalty.

For the sale of goods, the withdrawal period begins on the date the Buyer, or a third party designated by the Buyer, receives the product.

To exercise this right, the Buyer must notify the Seller of the decision to withdraw within the applicable period.

The notification may be submitted using a standard withdrawal form or any other clear statement expressing the Buyer's decision.

Following the withdrawal notification, the Buyer must return the product within the period prescribed by applicable legislation, which is 14 days unless otherwise provided by law.

The Seller shall reimburse the amounts collected in accordance with the deadlines and conditions established by applicable legislation, using a payment method consistent with the Buyer's original payment method.

8. Withdrawal and Cancellation of Pre-Order Products

The Buyer's statutory consumer rights remain applicable to pre-order products, except where a specific legal exemption from the right of withdrawal applies.

The mere designation of a product as a “pre-order” item does not automatically exclude the Buyer's right of withdrawal.

However, once a pre-order has been placed, procurement, reservation, importation, or other operational processes may commence.

The Buyer is therefore encouraged to carefully review product descriptions, estimated delivery times, specifications, and any applicable special conditions before placing an order.

Where a product falls within a statutory exception to the right of withdrawal, the Seller shall provide the required information on the relevant product page.

9. Exceptions to the Right of Withdrawal

Under applicable legislation, the right of withdrawal may not apply to certain contracts or product categories.

Examples include:

• Products specifically manufactured or customized according to the Buyer's individual requests or personal requirements.
• Products that are liable to deteriorate rapidly or expire.
• Products that are unsuitable for return due to health or hygiene reasons where protective packaging, seals, or similar protective elements have been opened after delivery.
• Other products or contracts expressly exempted under applicable legislation.

These exceptions shall be assessed according to the nature of the product and the applicable legal provisions.

10. Return Conditions

Products returned under the statutory right of withdrawal should be sent back complete and in appropriate condition, except for handling reasonably necessary to inspect their nature, characteristics, and functionality.

Where applicable, the Buyer is expected to include the original packaging, box, accessories, invoice, and any promotional items supplied with the product.

The Buyer may be liable, under the conditions established by applicable law, for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functionality.

Nothing in this section shall limit the Buyer's statutory withdrawal rights or rights concerning defective goods.

11. Damaged, Defective, or Incorrect Products

The Buyer is encouraged to inspect the products within a reasonable period following delivery.

In such circumstances, the Buyer's statutory rights and remedies under Turkish Consumer Protection Law No. 6502 and other applicable legislation shall remain fully reserved.

12. Electronic Records and Evidence

The Parties acknowledge that the Seller's electronic records, order records, system logs, commercial books, and email correspondence may be considered evidence in disputes arising from this Agreement, subject to applicable procedural law.

This provision shall not restrict the Buyer's statutory rights concerning evidence or legal proceedings.

13. Dispute Resolution

Disputes arising from this Agreement shall be referred to the competent Consumer Arbitration Committees or Consumer Courts in accordance with the monetary thresholds announced annually by the Turkish Ministry of Trade and the applicable legislation.

The Buyer's statutory rights to submit complaints, applications, or legal claims shall remain reserved.

14. Entry into Force

Before completing the order through the website, the Buyer acknowledges having been provided access to this Agreement, having received the relevant information, and having given electronic approval.

This Agreement enters into force on the date of its electronic acceptance.
